Background and Reference Information
Procedural Regulations and Law
OK, first, here is your insomnia cure: NMAC 20.1.4 Procedures for Conducting Public Hearings
If you intend to contribute comments to the hearing you should at least skim this portion of NMAC (New Mexico Administrative Code.)
It is also important to familiarize yourself with NMED’s Air Quality General Provisions.
One of the points we attempted to make in the Motion to Dismiss hearing was that Roper failed to follow the procedures to apply for an Air Quality permit.
The Hearing Officer was heard by me to say: Well, he made an attempt to comply. I have no doubt that comment didn’t make it into the record.
Last and apparently least in the eyes of the Hearing Officer is NMAC 20.2.74, Prevention of Significant Disturbance.
Technical Testimony
All of the parties presenting technical testimony were required to have that testimony submitted in writing by January 19. These are presented here in alphabetical order and not necessarily the order they will appear in the hearing:
New Mexico Environment Department
Roper
Sonterra (Altocep)
Other Information
This brochure prepared by the Ruidoso/Lincoln County Association of Realtors (RLCAR) provides an excellent summary of the problems this plant will create if it is constructed.
One More Thing
Our small council is putting a lot of effort and time and even individual financial financial contributions into opposing the batch plant. We cannot go it alone.
Our bills are mounting quickly for legal and engineering services such as the technical testimony linked above on this page. Please consider making a monthly contribution of $25, $50, or even $100. Whatever you can afford. It will really help.
