What does a Texas Two-Step Victory Dance Look Like?
Our May 13, Boot Bash Fundraising Event has just become a FUNdraising Celebration! Our attorney, Tom Hnasko, has just received a copy of the conclusions and Recommended Final Order from Hearing Officer Gregory Chakalian which is to be submitted on Tuesday, May 9.
The previously scheduled Boot Bash Fundraising event has just become a celebration. This outcome is a result of the overwhelming (to NMED’s senses) opposition to the move by Roper Construction.
The 56 page Hearing Officer’s report comes as a surprise based on statements made during the Public Hearing, but we admit we (your scribe and the mouse in his pocket) read all the “tells” wrong.

Can Roper appeal this decision?
What is the balance which we owe to our ATTORNEY?
1. I suppose he can appeal but he would have to produce overwhelming and credible evidence that the five (5) reasons given for denying the application are reversible. Because the first three deal with the topography and meteorology of the location, it isn’t likely he can bend that reality. The last two call into question the veracity of his initial application which he has already revised 20 times after challenges, another high hurdle.
In similar challenges elsewhere (TX), the operator withdrew the the application upon learning of opposition. We have not been able to suss Roper’s intractability.
2. As of the end of April, our outstanding balance is roughly $310,000 and we have already submitted $200,000. Our attorney, Tom Hnasko, has been very generous by allowing us the ability to settle the debt by installment payments. We are grateful for the financial support we have received to date. Thank you. We have won this battle, but the war against Heavy Industry Polluters wanting to invade and despoil our area is still ongoing. Now is definitely the time to keep the Lincoln County Commissioners on notice that they must take action to prevent future attempts to invade our community because they cannot be accused of taking sides – even if they should have – in a dispute.
Great News ! One more victory for our natural mountain scenic lifestyle. One more victory for wildlife. Thank you for fighting the companies who try to exploit our natural resources and care a less about the damage of our ecosystem , and what the community cares about. This was never about stopping free market but stopping an attack on our beautiful mountain. Batch plants should not be in neighborhoods and near wilderness areas.
